The lawyer Magomed-Basir Ozdoyev filed a complaint to the European Court of Human Rights against the fine of Mufti Isa Khamkhoyev for organizing an unsanctioned public event. This was reported to Fortanga by the lawyer himself.
He recalled that earlier Magas district court and then the Supreme Court of Ingushetia found Mufti of the republic Isa Khamhoev guilty of organizing an unsanctioned event on August 10, 2020.
Ozdoyev noted that it was a religious meeting, which was held indoors, and not a public event with political and other demands.
«Even if it had been a rally, Khamkhoyev was not obliged to coordinate the event because less than a hundred people came to it,» the lawyer explained.
In the complaint, the defence demands to recognize the decisions of Russian courts as groundless and politically motivated, Ozdoyev said.
As we have earlier reported, at the end of April this year Khamkhoyev was fined 10 thousand rubles for violation of the established procedure for organizing or holding a public event (Article 20.2 part 1 of the Administrative Offences Code) for a religious meeting held on August 10, 2020.
On this day in the Spiritual center of Moslems elections of new mufti took place. 67 people were present at the meeting. The court considered Isa Khamkhoyev to be the organizer of the event, although at the time of the election Mukhamad Khashtyrov was acting mufti.
We would remind you that on August 10, 2020 Isa Khamkhoyev was elected Mufti of the republic. He received 32 votes out of 58. The alternative candidate — Magomed Khashtyrov — received 21 votes of the meeting participants. A total of 78 regular members of the assembly were to be present.
